Dispute Resolution for Corporate Lawyers and Clients: A practical Overview and Drafting Tips and Pitfalls.

The resolution of commercial disputes is often governed by a dispute resolution (“DR”) clause contained in the underlying transaction documentation.  The decision whether or not to include such a clause, and if so, what it will contain and how it is to be drafted, is frequently made by corporate lawyers and their clients, without input from dispute resolution specialists. 

Because of this, it is crucial that corporate lawyers and their clients have a fundamental understanding of the various methods available for resolving disputes, when they should be used, when they should be avoided, and how they should be documented.
