Construction Contracts Act Adjudication
Timing is Important
In keeping with the underlying principles of the Construction Contracts Act, we believe timing is very important. That is why we will use our best endeavours to provide the right nomination expeditiously – usually within 3 working days and often within 1 working day.
We will require compliance with timing from others in 2 respects:
- The request for a nomination must be received within 5 working days of service of the Notice of Adjudication. If it is received after this time the claimant will need to provide evidence that the respondent has agreed to extend the time for the request or we will require the claimant to serve the documents again.
- Nominees must be available to accept a nomination and adjudicate promptly.
Receiving the Right Nomination
AMINZ provides an independent nominations service. View our criteria for selection . If there is an adjudicator a claimant wishes to have appointed, s/he can state this or can state the type of qualifications for the adjudicator that may be preferable. These types of requests will be taken into account, but will not necessarily lead to a particular adjudicator being appointed. If we are provided with evidence of the agreement of the respondent to any request however, this will be much more influential on the final appointment.

All AMINZ members are bound by the Institute’s rules and code of ethics. Public assurance is maintained by the disciplinary procedures for dealing with complaints of professional misconduct. Members who are found guilty of professional misconduct can be sanctioned by the Institute
